Interview with Steve Bliss, Wildomar Trust Attorney

Good morning, Wildomar! This is Brenda Walters reporting live for Wildomar News. Today we’re speaking with Steve Bliss, a renowned trust attorney here in Wildomar, about the importance of estate planning and the various types of trusts available to individuals and families.

Understanding Trusts: A Foundation for Security

Steve, thanks for joining us today. Could you start by explaining what a trust is and why it’s such an important tool in estate planning?

“A trust is essentially a legal arrangement where you transfer assets to a trustee who manages them according to your wishes,” explains Steve Bliss. “The trustee can be an individual, a bank, or even a corporation. You, as the grantor, create specific instructions outlining how and when the assets should be distributed to your beneficiaries.”

“Trusts offer numerous benefits,” Steve continues. “They help avoid probate, which can be a lengthy and costly process. Trusts also provide privacy, as the terms of the trust are not publicly disclosed. Moreover, trusts can be structured to minimize estate taxes and protect assets from creditors.”

The Irrevocable Trust: A Powerful Tool for Asset Protection

Steve, you mentioned that trusts come in different types. Could you elaborate on one specific type and its advantages?

“An excellent example is the irrevocable trust,” Steve explains. “Unlike a revocable living trust, which can be amended or dissolved during your lifetime, an irrevocable trust cannot be easily changed once established.”

“While this may seem limiting,” Steve clarifies, “it’s precisely what makes irrevocable trusts so powerful for asset protection and estate tax planning. By transferring assets into an irrevocable trust, you essentially remove them from your taxable estate. Consequently, this can significantly reduce potential estate taxes upon your passing.”

“Furthermore,” Steve adds, “irrevocable trusts can shield assets from creditors and lawsuits. This is because the assets are legally owned by the trust, not by you personally. Accordingly, creditors generally cannot access assets held within an irrevocable trust.”

“However,” Steve cautions, “it’s crucial to remember that setting up an irrevocable trust is a significant decision. It should be done with careful consideration and guidance from an experienced attorney like myself.”

Real-World Experience: Protecting Families

Steve, have you encountered any situations where the use of an irrevocable trust has been particularly beneficial for your clients?

“I remember a case involving a family business owner,” Steve recalls. “He was concerned about potential lawsuits targeting his assets. We created an irrevocable trust to hold a portion of his business interests and personal assets. This protected those assets from creditors should he face legal action.”

“The peace of mind this provided my client was immeasurable,” Steve adds. “Knowing that a portion of his hard-earned wealth was safeguarded allowed him to focus on running his business without constant worry.”

Trusts: A Cornerstone of Financial Security

“According to the American Bar Association, over 50% of Americans die without a will or trust in place,” Steve shares. “This can lead to significant complications for loved ones during an already difficult time.”

“By taking proactive steps and establishing a trust,” Steve emphasizes, “individuals can ensure their wishes are respected, their assets are protected, and their families are taken care of after they’re gone.”
