I’m sitting down today with Ted Cook, an elder protection attorney here in sunny San Diego. Ted, thanks so much for taking the time to chat with me.
What Inspired You To Focus On Elder Protection Law?
It wasn’t a straight path, that’s for sure. Early on in my career, I handled a variety of cases. But something about seeing seniors taken advantage of, whether financially or through neglect, really struck a chord with me. There’s a vulnerability there that needs to be addressed. Helping people navigate those complex legal issues and ensure their safety and well-being became my passion.
Can You Walk Us Through The Different Steps Involved In Elder Protection?
Absolutely. Think of it like a roadmap, guiding us towards protecting our elders. We have six key stages:
- Initial Client Engagement
- Case Assessment
- Protective Actions
- Legal Proceedings
- Long-Term Planning
- Case Resolution & Follow-Up
Let’s Dive Deeper Into “Protective Actions.” What Does That Entail?
That’s where we shift from assessment to action. The goal here is immediate safety and security for the elder. We might need to file for restraining orders against abusers, notify Adult Protective Services if there are signs of neglect, or even petition the court for guardianship or conservatorship if someone lacks the capacity to make their own decisions.
“Ted was a lifesaver when my mother was being financially exploited. He acted quickly, got a freeze on her accounts, and helped us untangle the mess. I don’t know what we would have done without him.” – Mary S., La Jolla
Sometimes these situations require swift intervention, which can be stressful for everyone involved. It’s crucial to have clear communication and empathy during this stage.
Remember that one time when a client’s caregiver was transferring funds into her own account? The client had dementia and was completely unaware. We were able to freeze the accounts in time, preventing further losses. It wasn’t easy dealing with the caregiver, who denied any wrongdoing, but we presented the evidence and ultimately protected our client’s assets.
“Ted’s knowledge of elder law is impressive. He explained everything clearly and made sure I understood all my options. He fought hard for my rights and helped me regain control of my life.” – John D., Point Loma

“Peace of mind is priceless. Knowing that Ted is looking out for my family gives me tremendous comfort.” – Susan B., Coronado
