Steve, can you walk us through one of the key steps in the estate planning process?
Certainly. One of the first major steps after someone passes away is filing a petition for probate. This step is crucial as it officially initiates the probate process and sets everything in motion.
First, we need to determine if probate is even necessary. If the estate’s value exceeds $184,500, or if there isn’t a valid will designating beneficiaries for all assets, then probate will likely be required. Conversely, if the estate falls below this threshold and all assets are held in non-probate forms like trusts or joint tenancy, probate can often be avoided.
If probate is necessary, we file Form DE-111 with the Superior Court in the county where the decedent resided. This petition requests the court to appoint an executor or administrator – someone responsible for managing the estate and distributing assets according to the will or state law. We also submit the original will to the court, if one exists.
I’ve found that this stage can be quite emotional for families. Losing a loved one is incredibly difficult, and navigating legal processes while grieving can feel overwhelming. Consequently, my role as an attorney is not just about legalities but also about providing support and guidance during this sensitive time.
