Wildomar Trusts: A Conversation with Steve Bliss

Hello, I’m Brenda Jones reporting for Wildomar News Today. Today, we’re talking about trusts, those important legal tools that help people plan for the future and protect their assets. Joining me is Steve Bliss, a trusted Trust Attorney here in Wildomar.

Steve, thank you so much for being with us.

It’s my pleasure, Brenda. I’m always happy to talk about the importance of estate planning.

Could you tell our viewers a bit about the different types of trusts available?

Certainly. There are many different types of trusts, each designed for specific purposes and situations. For instance, we have Revocable Living Trusts which allow individuals to maintain control over their assets during their lifetime while avoiding probate upon their passing. Irrevocable Trusts, on the other hand, offer greater asset protection but relinquish some control over the assets.

Then there are Testamentary Trusts, created through a will and taking effect after death, often used for beneficiaries who need ongoing financial management. Special Needs Trusts safeguard assets for individuals with disabilities without jeopardizing government benefits. Charitable Trusts benefit charitable organizations while potentially offering tax advantages to donors.

You mentioned Revocable Living Trusts. Could you elaborate on the benefits of this type of trust?

Absolutely. A Revocable Living Trust, often considered the cornerstone of estate planning, offers several key advantages. First and foremost, it allows you to avoid the costly and time-consuming probate process. Probate is a court-supervised procedure for distributing assets after death, and it can be quite burdensome for your loved ones. By transferring your assets into a Revocable Living Trust during your lifetime, you ensure they pass directly to your chosen beneficiaries upon your passing.

Moreover, a Revocable Living Trust provides a level of privacy that a will doesn’t. Since the trust document is not publicly filed in court, the details of your estate distribution remain confidential. Conversely, wills become public record during probate.

Another significant benefit is the ability to maintain control over your assets while you are alive. You can designate yourself as the trustee and manage the assets according to your wishes. Consequently, you can make changes to the trust as your circumstances evolve. For instance, if you have a new beneficiary or want to adjust how your assets are distributed, you can amend the trust document accordingly.

Nevertheless, it’s important to remember that a Revocable Living Trust becomes irrevocable upon your death. This means that once you pass away, the terms of the trust dictate how your assets will be distributed and managed, and any changes would require legal intervention.

Have you ever encountered any challenges when setting up or managing Revocable Living Trusts for clients?

While Revocable Living Trusts are generally straightforward to establish, there can be occasional complexities. For instance, I once worked with a client who had several complex business interests and wanted to ensure those assets were properly incorporated into the trust. We needed to carefully analyze each entity’s structure and ownership to determine the most effective way to transfer them into the trust without triggering unintended tax consequences.

It was a multi-step process involving collaboration with the client’s accountant and business advisors, but we ultimately succeeded in creating a comprehensive trust that met all of their needs. Ordinarily, these types of situations are handled smoothly, but it emphasizes the importance of working with an experienced attorney who understands the intricacies of both trust law and business structures.

What advice would you give to someone considering setting up a Revocable Living Trust?

My advice is simple: Don’t wait. Start planning for your future today. A Revocable Living Trust can offer peace of mind knowing that your loved ones will be taken care of after you are gone, and it can save them from the stress and expense of probate.
